Law firm “Deshunin and Partners” has defended client’s rights in European court of human rights.

On 17th of July 2014 European court of Human Rights made a decision on claim # 31 against Ukraine in case “Yarovenko and others against Ukraine”. Subject matter of a claim was failure of the State of Ukraine to fulfill decisions of national courts taken in favor of the applicant.

Managing Partner of Law Firm "Deshunin and partners," the attorney Sergei Deshunin, representsin case here above one of the applicants legal entity. The State of Ukraine has a debt t of over 5 million USD before this legal entity. This claim is one of the biggest claims among claims on case "Yavorovenko and others against Ukraine."

As a result of application proceedings, European Court of Human Rights based on the results of the proceedings stated the following violation by the State of Ukrainian:

  • Article 6 § 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter - the Convention) - right to a fair trial; 
  • Article 13 of the Convention - the right to an effective remedy; 
  • Article 1 of Protocol 1 to the Convention – right for ownership 

Given the above, European court has forced Ukrainian State in three moth as of date of making a resolution first, to execute to the full extent national court decisions, second , to pay in favor of each of claimers a compensation of moral and material harm in the amount of 2 000,00 euro.

Decision f European court of human rights as of 17.07.2014 is an important step in the process of defending violated human rights of all the claimers in case “Yarovenko and others against Ukraine”. Resolution , mentioned hereabove has created important judicial precedent, which according to Ukrainian law “On implementation and application of the decisions of European Court of Human Rights" is binding for the state and has to become an effective tool of influence in the performance of other judicial acts which are not covered in the Resolution of European Court of Human Rights.
